From a legal standpoint, bourbon, unlike other varieties of whiskey, must be distilled and aged in the U.S. Other legal restrictions that bourbon distillers must follow are:

• Bourbon must be distilled from at least 51% corn. The rest can be made up of other types of cereal grains such as wheat, barley, or rye. This combination of fermented grains is known as the mash bill.
• It must be aged in new, charred barrels that are constructed from American white oak. This helps the spirit get its color, and the wood even adds to its flavor. While there is no specific aging period, it is generally aged for months or even years. Bottles often are labeled with the number of years the bourbon has been aged. This is called the age statement.
• Bourbon must be at least 80 proof (40% ABV). Furthermore, it must be distilled to no more than 160 proof (80% ABV) and must be at no more than 125 proof (62.5%) as the barrel aging process begins.

A special type of bourbon, called Straight Bourbon, has additional restrictions. It is required to be aged for at least two years and must have an age statement if aged less than four years. Straight bourbon also cannot be made with additives such as caramel coloring.
